APPLICATION TERMS AND CONDITIONS - READ CAREFULLY!

This Application for Credit Services (the "Application") is not a promise to provide any credit services to Applicant, nor is it a promise that MK PayDay LLC ("we," "us," "our" and "CSO") can assist Applicant in obtaining an extension of credit. Applicant acknowledges that we may accept or reject, at our discretion, Applicant's request for credit services. Until we accept Applicant's request for credit services and we enter into a Credit Services Agreement with Applicant, we shall have no obligation to provide credit services to Applicant. Applicant understands that CSO is not required to submit Applicant's request for an extension of credit to a third party lender unless CSO decides to enter into a Credit Services Agreement with Applicant.

CONSENT TO DISCLOSE INFORMATION TO LENDER: APPLICANT CONSENTS TO THE DISCLOSURE OF THE INFORMATION ON THIS APPLICATION TO RAND ARCADIA INVESTMENTS, LLC ("LENDER") FOR ITS USE IN DETERMINING WHETHER TO PROVIDE AN EXTENSION OF CREDIT TO APPLICANT, SECURED IN PART BY CSO'S GUARANTY. ALL CREDIT DECISIONS WILL BE MADE BY LENDER. IF LENDER APPROVES APPLICANT FOR AN EXTENSION OF CREDIT, APPLICANT SHALL BE REQUIRED TO ENTER INTO A LENDER DISCLOSURE AND PROMISSORY NOTE.

REPORTING TO CREDIT BUREAUS: We may report information concerning your account or transaction(s) with us to credit bureaus. Late payments, missed payments or other defaults on your account may be reflected on your credit report.

GOVERNING LAW: This Application will be governed by the laws of the State of Texas.

GOVERNING LAW: This Application is submitted subject to and in accordance with the separate Waiver of Jury Trial and Arbitration Agreement entered into by and between Applicant and CSO contemporaneously with this Application. If you have not already done so, please read that document before signing this Application.

BY CLICKING CONTINUE BELOW, (a) you certify that all of the information provided above is true, complete and correct and provided to us, for the purpose of inducing us to provide the extension of consumer credit for which you are applying; (b) you are requesting that this information be provided to the Lender for the purpose of inducing the Lender to provide the extension of credit for which you have requested our credit services to obtain; (c) you acknowledge and agree that you have read, and understood all of the terms on all pages of this Application, and have separately read, understood and executed a WAIVER OF JURY TRIAL AND ARBITRATION AGREEMENT; (d) you agree that this Application and any related transaction involves interstate commerce; (e) you acknowledge that we have contracted with the Lender, to provide assistance in processing your Application and servicing and collecting your extension of credit; (f) you authorize us and the Lender to obtain and to share with each other and our respective affiliates information about you, including consumer reports, for the duration of this transaction and any subsequent extension of credit; (g) you acknowledge that you have received and/or read our Privacy Policy and the Lender's Privacy Policy; (h) you authorize us and the Lender to contact you and/or your personal contacts listed above at home or work within times allowed by law; (i) you agree to all the terms of this Application and warrant that you are not a debtor under any proceeding in bankruptcy and have no intention to file a petition for relief under the United States Bankruptcy Code; and (j) you acknowledge that you have been advised that the credit services obtained from the CSO and any extension of credit obtained from the Lender pursuant to this Application may not be at the lowest rate or best terms available, and that you may look elsewhere for services and an extension of credit.
